Affiliate Terms & Conditions

These Affiliate Terms and Conditions (“Agreement”) govern the relationship between Trufelo Studio (“Company”, “we”, “us”, or “our”) and you (“Affiliate”, “you”, or “your”) with respect to your participation in the Trufelo Studio Affiliate Programme (“Programme”).

By applying to, being accepted into, or participating in the Programme, you agree to be bound by this Agreement in full. If you do not agree with any part of these terms, you must not participate in the Programme.

We reserve the right to update or modify this Agreement at any time. Continued participation in the Programme following notification of changes constitutes your acceptance of the revised terms.

To participate in the Programme, you must: (a) be at least 18 years of age; (b) have a valid, active online presence (website, social media profile, email list, or other digital channel); (c) comply with all applicable laws and regulations in your jurisdiction; and (d) not be a direct competitor of Trufelo Studio.

Trufelo Studio reserves the sole right to approve or reject any affiliate application at its discretion, without obligation to provide a reason.

Applications are typically reviewed within 48 hours. Approval grants you a non-exclusive, non-transferable licence to promote Trufelo Studio’s products and services under the terms of this Agreement.

We reserve the right to terminate any affiliate account at any time if we determine that the Affiliate has violated this Agreement, engaged in fraudulent activity, or caused harm to the Trufelo Studio brand.

Upon approval, you will be provided with a unique referral link (“Affiliate Link”) to use in your promotional activities.

Referrals are tracked using cookies with a 90-day duration from the date a prospective customer first clicks your Affiliate Link. If the cookie is cleared, the device is changed, or the user accesses Trufelo Studio through another affiliate’s link after yours, the referral credit may not be attributed to you.

You are responsible for ensuring your Affiliate Link is correctly embedded in your promotional materials. Trufelo Studio is not responsible for lost commissions due to incorrectly implemented links.

You must not modify, cloak, or obscure your Affiliate Link in a way that misrepresents its destination or prevents accurate tracking.

Affiliates earn a 20% recurring commission on all payments made by referred customers for as long as they remain active paying subscribers.

Commissions are calculated on the net revenue received by Trufelo Studio, excluding taxes, refunds, chargebacks, and transaction fees.

Commission rates are subject to change with 30 days’ written notice to active affiliates. Changes will not affect commissions already earned prior to the effective date of any change.

Commissions are earned only on new customer referrals. Existing Trufelo Studio customers who sign up via your Affiliate Link are not eligible for commission.

There is a 60 day lock period after a successfull paid subscription activation. Commissions are paid on a monthly basis, typically within 15 business days following the end of each calendar month.

The minimum payout threshold is £200. If your earned commissions do not reach this threshold in a given month, the balance will roll over to the following month.

Payments are made via PayPal or Stripe, as selected in your affiliate dashboard. You are responsible for providing accurate and up-to-date payment details. Trufelo Studio is not liable for payments made to incorrect accounts due to inaccurate information provided by you.

Any applicable taxes on commission income are the sole responsibility of the Affiliate. Trufelo Studio does not withhold tax on behalf of Affiliates unless legally required to do so.

Commissions are subject to a 30-day holding period to account for potential refunds or chargebacks. Commissions on refunded or charged-back transactions will be reversed.

You agree to promote Trufelo Studio honestly, accurately, and in a manner consistent with the brand guidelines provided in the affiliate portal.

You must clearly disclose your affiliate relationship with Trufelo Studio in all promotional materials, in compliance with applicable advertising standards and regulations (including FTC guidelines in the United States and ASA guidelines in the United Kingdom).

You must not make false, misleading, or exaggerated claims about Trufelo Studio’s products, features, pricing, or results.

You are prohibited from using Trufelo Studio’s name, logo, or trademarks in any way that implies official endorsement, partnership, or employment beyond your role as an affiliate, without prior written consent.

You may not use Trufelo Studio’s branding in paid advertising (including Google Ads, Meta Ads, or any PPC campaign) without prior written approval from Trufelo Studio.

The following activities are strictly prohibited and will result in immediate termination of your affiliate account and forfeiture of any unpaid commissions:

(a) Spam — sending unsolicited emails, messages, or posts to promote your Affiliate Link;

(b) Misleading advertising — using false claims, fake testimonials, or deceptive tactics;

(c) Cookie stuffing — artificially inflating referrals by placing affiliate cookies on users’ devices without their knowledge;

(d) Self-referrals — using your own Affiliate Link to sign up for Trufelo Studio yourself or for accounts you control;

(e) Incentivised clicks — paying or incentivising others to click your Affiliate Link without genuine purchase intent;

(f) Trademark bidding — bidding on Trufelo Studio’s branded keywords in paid search without prior written approval;

(g) Promotion on — adult, hate, illegal, or otherwise harmful content platforms.

(h) Unauthorised email marketing — sending promotional emails that reference Trufelo Studio without explicit opt-in consent from recipients, or using purchased, rented, or scraped email lists in any form;

(i) Impersonation — misrepresenting yourself as an employee, official representative, or spokesperson of Trufelo Studio in any communication, platform, profile, domain name, social media handle, or marketing material. This includes creating accounts, websites, email addresses, or any content that could reasonably lead others to believe you are acting on behalf of, or are affiliated with, Trufelo Studio in any official capacity;

(j) Domain or brand mimicry — registering domain names, social media usernames, or creating any digital asset that contains or closely resembles the Trufelo Studio name, logo, or brand identifiers, intentional or unintentional misspellings of the Trufelo brand (e.g. ‘Trufello’, ‘Trufelo Studio’, ‘Trufel’), and any derivative whether for promotional or any other purposes, without prior written authorisation.

(k) Brand bidding / PPC hijacking — running paid search advertisements (including Google Ads, Bing Ads, or any other pay-per-click platform) that bid on Trufelo Studio’s brand name, brand variants, or any keywords that include or closely resemble the Trufelo name. This includes, but is not limited to, exact and broad match terms such as ‘Trufelo’, ‘Trufelo Studio’, ‘Trufelo discount’, ‘Official Trufelo’, ‘Trufelo pricing’, ‘Trufelo review’, intentional or unintentional misspellings of the Trufelo brand (e.g. ‘Trufello’, ‘Trufelo Studio’, ‘Trufel’), and any derivative or phonetically similar keyword combinations. Affiliates found in violation of this clause will have their account terminated immediately and any outstanding commissions forfeited.

Trufelo Studio grants you a limited, non-exclusive, revocable licence to use the promotional materials, logos, and brand assets provided in the affiliate portal solely for the purpose of promoting Trufelo Studio under this Agreement.

You may not alter, adapt, or create derivative works from Trufelo Studio’s intellectual property without prior written consent.

All intellectual property rights in Trufelo Studio’s products, branding, and materials remain exclusively with Trufelo Studio. This Agreement does not transfer any ownership of intellectual property to you.

As an Affiliate, you may have access to non-public information about Trufelo Studio’s business, commission rates, or promotional strategies. You agree to keep such information confidential and not disclose it to third parties.

This confidentiality obligation survives the termination of this Agreement.

This Agreement commences on the date your affiliate application is approved and continues until terminated by either party.

Either party may terminate this Agreement at any time with written notice. Upon termination, your Affiliate Link will be deactivated and you will no longer earn commissions on new referrals.

Commissions earned prior to termination will be paid out in accordance with the standard payment schedule, provided there are no outstanding violations of this Agreement.

Trufelo Studio reserves the right to withhold payment of commissions earned through fraudulent, deceptive, or prohibited activity.

To the maximum extent permitted by law, Trufelo Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your participation in the Programme.

Our total liability to you under this Agreement shall not exceed the total commissions paid to you in the three months preceding the event giving rise to the claim.

Trufelo Studio does not guarantee any specific level of earnings from the Programme. Commission income will vary based on your audience, promotional efforts, and market conditions.

You agree to indemnify, defend, and hold harmless Trufelo Studio, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including legal fees) arising out of or related to:
(a) your breach of this Agreement;
(b) your promotional activities;
(c) your violation of any applicable law or third-party rights.

This Agreement shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.

Any dispute arising out of or in connection with this Agreement shall first be subject to good-faith negotiation between the parties. If the dispute cannot be resolved within 30 days, it shall be submitted to the exclusive jurisdiction of the courts of England and Wales.

Nothing in this clause shall prevent either party from seeking urgent injunctive relief.

Entire Agreement: This Agreement constitutes the entire agreement between the parties with respect to the Programme and supersedes all prior agreements, representations, and understandings.

Severability: If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

No Waiver: Failure by either party to enforce any provision of this Agreement shall not constitute a waiver of future enforcement.

Assignment: You may not assign or transfer your rights or obligations under this Agreement without Trufelo Studio’s prior written consent.
